Upon conviction, the person could deal with time in prison. According to the Revised Statutes, marijuana possession can be classed between a class-6 and a class-4 felony. Possession of dangerous drugs or narcotics is a class-4 felony, as well. A class-6 felony could lead to a one-year imprisonment, and a class-4 felony could give rise to a 2.5-year sentence. An individual could also be indicted for a crime possession with intent to distribute (PWID), or with possession for sale.

Transferring, selling and transporting marijuana, narcotics or dangerous drugs is classified as a class-2 felony (even though marijuana distribution could also be a class-3 felony whether the amount is less than two pounds). As a class-2 felony, the sentence could be as many as five years in jail. As for trafficking, it is also penalized in the same manner.

Sentences for Drug Possession Charges
Drug possession laws are strict. Drugs are split up into separate classifications and the sentences change accordingly. There are six (6) different groups, including:

For further information about this breakdown, take a look at the Code Sections. The sentences change between felonies and misdemeanors. Possession of peyote; for instance, is a Class 6 felony which holds sentences including four (4) months to two (2) years in jail and a fine of up to $150,000.
For the category of drugs that emit toxic vapors, the accused person can be indicted for a Class 5 felony punishable by between six (6) months and 2.5 years in prison and up to $150,000 in fines. Marijuana possession sentences vary depending on the amount in possession, the breakdown follows these guidelines:
Less than two pounds of marijuana:
-Indicted as a Class 6 felony-Punishable by a jail sentence between four (4) months and 2 (2) years and $150,000 in fines
Between two pounds and four pounds:
-Indicted as a Class 5 felony-Punishable by between six (6) months and 2.5 years in prison and up to $150,000 in fines
Over four pounds:
-Indicted as a Class 4 felony-Punishable by between one (1) and 3.75 years in prison and up to $150,000 in fines
A crime for possession of prescription-only drugs is indicted as a Class 1 misdemeanor punishable by up to six (6) months in prison and a fine of up to $1,000. Possession of drugs and narcotic drugs is generally indicted as a Class 4 felony, which is punishable by between one (1) and 3.75 years in prison plus fines. Any of these sentences may be enhanced whether the crime was committed near a school or if the accused is a habitual wrongdoer.
